This Agreement is put into place to explain the details of a photo session with “Kristy TerHaar Photography, LLC” herein after referred to as “Photographer” and to make sure your expectations are met. Please read this entire document carefully. If you have any questions, please let me know before the session.
PHOTO SESSION & SCHEDULING
Session fees are non-refundable unless canceled at least 48 hours before the session. Fees paid may be credited towards a future session at photographer’s discretion. Seasonal, holiday, and limited edition sessions are ONLY available on SPECIFIC dates. Same day cancellations and No Show/No Calls are NON-REFUNDABLE and will not be credited to a future session.
I would never want to photograph someone not feeling well, so if any party of the session becomes ill, please call as soon as possible.
If Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to illness or emergency, then Photographer shall return the deposit to the Client, but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of Photographer. In the event Photographer fails to perform for any other reason, Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
Photographer and the studio are not liable for any injuries that occur during the session.
Photographer is not responsible if Client/children/session participants fail to appear or cooperate during portrait sessions, including but not limited to crying, shyness, grumpy, non-cooperation, undesired mannerisms, refusal to take photos, etc. Photographer is not responsible for hair, makeup, clothing choices, etc. Please try out new styles and new clothing ahead of time.
**No other cameras are allowed at the photo session, including cameras on phones.**
IMAGE PROOFING & ORDERING
Photographer will provide an online gallery of proofs within 14 days of session date. Gallery will then be available for 7 days, so please be prepared to select your images and/or place your order within that time. Images will be lightly edited for proofing. Final editing will be completed on the images purchased / selected for the package.
Each DIGITAL session includes the number of digital images as stated in the selected package at booking. Basic retouching (facial blemishes, b/w, chocolate, adding words) is included. For more detailed retouching (background changes, head swaps, glasses glare, etc.), there may be an additional charge. Client's gallery will not show ALL photos taken, but will show the best images at the Photographer’s discretion. Full payment is required before any orders or design-work is processed.
PHOTOGRAPHIC MATERIALS & MODEL RELEASE & SOCIAL MEDIA
Client understands that all photographic materials, including but not limited to negatives, transparencies, proofs, digital files and previews, shall be the exclusive property of Photographer. Photographer reserves the right to use the digitals/negatives/images and/or reproductions for display, publication, advertising, competition or other lawful purposes without compensation to the client. Copyright belongs to the photographer.
Client is obtaining prints/images for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than Photographer. It is a violation of federal copyright law to allow photographs created by Kristy TerHaar Photography, LLC to be digitally reproduced, copied or scanned without written permission. This includes screenshotting gallery proofs.
Please be aware that color dyes and inks in prints may fade or discolor over time, due to the inherent qualities of dyes and inks. Photographer is not liable for any claims based upon the fading or discoloration due to these inherent qualities.
Clients are welcome to tag images that Photographer posts on Facebook/Instagram/Social Media. If you prefer NOT to have images on social media, including sneak peeks, please let me know in the NOTE section below.
DIGITAL IMAGES (if purchased)
Digital Images, may be cropped and colored how Photographer believes they will print the best. Some images (particularly those shot in low light) may have visible film grain when enlarged too much. This is normal. In addition, if Client crops an image in too tightly, resolution may be lost and may cause it to be pixelated when enlarged. To ensure the best print quality, try to avoid altering images before printing. If in doubt, feel free to ask!
A print release will be provided to Clients to print up to 11x14 to keep image size manageable. Photographer recommends printing through you gallery or using www.unitprints.com, or another comparable quality lab. Discount and one hour labs may produce lower quality images with inconsistent color. Photographer is not responsible for printing errors or for quality of prints or products not printed directly through Photographer.
Client agrees to download the HIGH RESOLUTION digital images to a COMPUTER within 7 days of receiving your gallery. Use only the HIGH resolution images when printing. The low resolution images are small and sized for social media sharing, but are too low to print a quality image.
AGREEMENT
By booking this session and signing below, Client confirms agreement to all terms and conditions outlined in this above. The person booking as Client shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement. Client must be at least 18 year of age to enter this agreement. Clients under 18 must have a parent or guardian book the session in order to enter into agreement.
